Terms & Conditions for Trade Promotions, Competitions & Giveaways
1. Introduction
Welcome to Lappies Unleashed - our online Blog and Boutique website - www.lappiesunleashed.com ("the Site"). By participating in and/or submitting an entry to any of our trade promotions, skill-based competitions or giveaways ("the Promotion"), you agree to be bound by these Terms and Conditions for Trade Promotions, Competitions & Giveaways ("Promotion Terms"):
1.2 These Promotion Terms are effective as of 27 November 2024 and may be updated from time to time with a new updated date (below). We reserve the right to update the Promotion Terms at any time.
2. Eligibility
2.1 To enter the Promotion, you must be at least 18 years old & be an adult with legal capacity. You must submit your entry to the Promotion yourself, and not on behalf of another person.
2.2 The Promotion is open to individuals residing in Australia, the UK, Canada, the USA, Finland, Denmark, Norway, Netherlands and New Zealand, unless otherwise specified in the individual Promotion's details.
2.3 Employees, affiliates, or immediate family members of staff are not eligible to enter the Promotion.
2.4 You provide your consent to these terms by entering, participating in and submitting your content to the Promotion.
2.4 All communication regarding the Promotion will be in English and all entries and user-submitted content for the Promotion must be in English to be eligible for the Promotion.
2.5 The Promotion is void where prohibited by law.
3. How to Enter
3.1 To enter the Promotion, participants must follow the specific entry instructions within the specified time period (concluding on the specified end date at 11:59pm AEST). Specific entry instructions and the promotion end date will be outlined in the Promotion’s announcement and on our social media channels or website.
3.2 Entries must be received by the specified end date before 11:59pm AEST. Entries submitted after this time will not be accepted.
3.3 Participants may only submit one entry per person, unless otherwise stated in the Promotion’s instructions.
3.4 Eligible entry in the Promotion is free.
3.5 All Promotions are skill-based competitions with a merit-based selection process and there is no element of chance involved.
4. Prize(s)
4.1 The winner(s) of the Promotion will receive the prize(s) as outlined in the Promotion announcement. The prize(s) will be awarded as stated and are non-transferable, non-refundable, and cannot be exchanged for cash or other prizes unless specified by us.
4.2 For the Current Promotion the prize is: a free $50 AUD gift card to our Boutique. All prices on our website are displayed in AUD. The gift card will be sent to the winner electronically and does not have an expiry date.
4.3 If the prize is unavailable, we reserve the right to substitute it with an alternative prize of equal or greater value at our discretion.
4.4 The winner will be notified via email/social media/message within 10 days of the Promotion end date.
4.5 If the winner does not respond or is unable to be contacted within 10 days of the initial notification, or if the winner is disqualified, an alternative winner will be selected within 6 weeks after the end date of the promotion.
4.6 All prize winners must comply with their local jurisdiction's laws on receiving a prize, including any implications for your individual income tax return, if applicable, and this is the individual prize winner's responsibility.
5. Winner Selection and Notification
5.1 Winners will be selected by merit-based selection and all eligible entries are skill-based for any trade promotions. The winner(s) of the Promotion will be selected based on the following criteria:
5.3 The winner will be notified as per the method outlined in Section 4.3. It is the winner’s responsibility to ensure their contact details are correct at the time of entry and they respond to our notification to receive their prize(s).
5.4 If the winner is disqualified or cannot be contacted, we reserve the right to select an alternative winner.
5.5 If there are no eligible entries to a Promotion by the end date, the Promotion will be cancelled (see 10.1).
6. Rights to Use Entries and Publicity
6.1 By entering the Promotion, you grant Lappies Unleashed/Diamontali the right to use your entry, name, image(s), and/or photo(s) on our social media, website, or for marketing purposes, including but not limited to promotional material related to this Promotion, without further benefit, compensation or permission.
6.2 By submitting a photo to Lappies Unleashed’s photo competitions, you grant Lappies Unleashed/Diamontali the non-exclusive worldwide licence and right to display, use and share your photo(s) on our social media accounts, website, and other promotional materials, for an unlimited period of time. You also confirm that you are the sole creator of the photo(s), and that it does not infringe on any third-party copyrights or intellectual property rights. If your photo(s) includes other identifiable people, you confirm that you have obtained their consent for their image to use their likeness in this way.
6.3 You agree that your participation in the Promotion constitutes your consent to these uses, unless prohibited by law.

7.1 We reserve the right to disqualify any participant who:

8.1 By entering the Promotion, you agree to the collection, storage, and use of your personal data by Lappies Unleashed/Diamontali in accordance with our Privacy Policy. Your personal information will only be used for the purposes of administering the Promotion, contacting winners, and social media marketing purposes unless you opt out.
8.2 If required by law, you may request access to your personal data, correct it, or request its deletion by contacting us at [email protected].
8.3 We will not share or sell your personal data with third parties except for the purposes of fulfilling the Promotion and in accordance with our Privacy Policy.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, Lappies Unleashed, Diamontali or any affiliated individual will not be liable for any loss, damage, or injury arising from your participation in the Promotion or your acceptance or use of the prize(s).
9.2 We are not responsible for any technical issues that may prevent entry or access to the Promotion, including issues related to the internet, social media platforms, or our website.
10. General Terms
10.1 We reserve the right to cancel, amend, or suspend the Promotion at any time without notice due, for example due to unforeseen circumstances or technical reasons. If there are no eligible entries to a Promotion by the end date, it will be cancelled.
10.2 If a Promotion is cancelled (see 10.1), it is immediately terminated and the promotion announcement will be removed from our website and the competition is cancelled. As part of our customer service, we will attempt to notify any participants by email, message or social media and offer to return the submitted photo or content to them, if possible. If a participant is unable to be notified and/or have their photo or content returned to them, it will be deleted 4 weeks after the Promotion cancellation. There is no benefit, prize or compensation for any participants and there is no further requirement upon Lappies Unleashed/Diamontali or any individual if a Promotion is cancelled.
10.3 If any part of these T&Cs is found to be invalid, the remainder of the T&Cs will remain in full force and effect.
10.4 These T&Cs are governed by the laws of Australia and any dispute arising from the trade promotion will be subject to the exclusive jurisdiction of the courts of Queensland.
10.5 By entering the Promotion, you agree to abide by these T&Cs, and confirm that you meet the eligibility requirements set forth herein.

- Merit-based Selection: The Promotion requires a skill-based submission (e.g., a photo entry/competition, personal story or creative content) and the winner will be chosen based on the quality, content and/or creativity of their entry.
- All entries will be judged individually on their merit by the Promotion sponsor. The judging criteria are:
- originality and creativity;
- visual appeal, content and style;
- pet personality, expression, interaction and appeal;
- emotional connection; and
- technical quality of the photo/submission.
- One winner will be selected based on the above criteria and how well their submission met the content for submissions specified in the Promotion announcement.
5.3 The winner will be notified as per the method outlined in Section 4.3. It is the winner’s responsibility to ensure their contact details are correct at the time of entry and they respond to our notification to receive their prize(s).
5.4 If the winner is disqualified or cannot be contacted, we reserve the right to select an alternative winner.
5.5 If there are no eligible entries to a Promotion by the end date, the Promotion will be cancelled (see 10.1).
6. Rights to Use Entries and Publicity
6.1 By entering the Promotion, you grant Lappies Unleashed/Diamontali the right to use your entry, name, image(s), and/or photo(s) on our social media, website, or for marketing purposes, including but not limited to promotional material related to this Promotion, without further benefit, compensation or permission.
6.2 By submitting a photo to Lappies Unleashed’s photo competitions, you grant Lappies Unleashed/Diamontali the non-exclusive worldwide licence and right to display, use and share your photo(s) on our social media accounts, website, and other promotional materials, for an unlimited period of time. 6.3 You agree that your participation in the Promotion constitutes your consent to these uses, unless prohibited by law.
7. Disqualification
7.1 We reserve the right to disqualify any participant who:
- Violates these T&Cs;
- Provides false or misleading information;
- Provides photos or any content that constitutes a violation (see 7.2)
- Attempts to manipulate or circumvent the entry process;
- Engages in any form of cheating, hacking, abusive, discriminatory, defamatory or fraudulent activity.
- Infringes copyright: The entry must be an original creation. If the content submitted contains third-party copyrighted material (e.g., images, logos, or music) without the necessary permissions or licenses, it will be disqualified.
- Harms or threatens others: Any photo, images, entries or content that includes harmful, offensive, or threatening language, or could be considered defamatory, discriminatory, harassing, or otherwise unlawful, will lead to disqualification.
- Violates intellectual property rights: Any content that infringes upon the intellectual property rights of others, including trademarks, patents, or trade secrets, will be disqualified.
- Violates privacy rights: If the content features individuals who have not provided proper consent for their image or likeness to be used, or if the entry violates the privacy rights of others, it will be disqualified.
- Contains inappropriate content: Any entry that contains explicit, obscene, discriminatory, defamatory, inappropriate, vulgar, or sexually suggestive material will be disqualified.
8. Data Protection and Privacy
